Daily activities in your Community Association create the opportunity for claims to emerge: a roof is being installed incorrectly, a guest trips and falls at the pool, an owner modifies a portion of the common elements, an owner fails to pay their assessment, or a storm causes property damage. Which incident might end up in court is unpredictable. Consequently, it is necessary to proceed as if every incident might be the one. Knowing the rules of evidence will assist Board Members and Property Managers in preserving evidence, establishing a proper record, and not compromising the Association’s position.
